The West Virginia lemon law in detailWest Virginia’s lemon law, article 6A of chapter 46A of the West Virginia Code, read in section 46A-6A-5 on the legislature’s site on November 1, 2026, protects a new motor vehicle during the warranty or the first year after delivery, whichever ends first. A reasonable number of attempts is presumed after three repairs of the same nonconformity, after one repair attempt for a nonconformity likely to cause death or serious bodily injury, or after a cumulative 30 calendar days out of service. The owner must have given the manufacturer prior written notification and at least one opportunity to cure. A dispute program step and a filing deadline were not in the section we read and are shown as not stated on this page.

One opportunity after notice
West Virginia joins the attempt counts to a single condition: the manufacturer must have heard from the owner in writing and had one chance to fix the defect. A dealer’s repeated failures are not enough on their own.
The other sections of article 6A deal with the remedies and the procedure. Our reading covered the presumption section only, which is why the deadline is marked as not stated. The code page is linked below.
