The Oklahoma lemon law in detail

Oklahoma’s lemon law, section 901 of title 15 of the Oklahoma Statutes, protects a new motor vehicle during the warranty term or the first year after delivery, whichever ends first. The section presumes a reasonable number of attempts after four repairs of the same defect, or after 30 business days out of service in that period. The owner must give the manufacturer prior direct written notice and an opportunity to cure, and a qualifying manufacturer dispute procedure must be used first. The refund deduction is the price times the miles beyond 15,000, divided by 120,000, and a consumer who wins may recover attorney’s fees. Vehicles over 10,000 pounds and the living quarters of a motor home are outside the section. We could only read the section, as amended in 2009, in an archived copy of January 9, 2019, so any amendment made after that date would not show here.

One section for the whole law

Oklahoma packs its lemon law into a single section of the consumer title. The Oklahoma State Courts Network publishes it, but its server did not answer our reader on the day of reading, so we rely on the archived copy named above. Before you rely on a figure, compare it with the section linked below.

A deduction with a free allowance

The first 15,000 miles cost nothing in an Oklahoma buyback. On a $40,000 car with 20,000 miles, the deduction is 5,000 miles times the price, divided by 120,000, or about $1,667.

The written notice is a condition: the manufacturer must hear from the owner directly, not only through the dealer, and must get one more chance to repair. Send the letter to the address given in the warranty booklet.

Questions people ask

How many repair attempts make a car a lemon in Oklahoma?

The Oklahoma presumption starts at 4 attempts on the same defect, or 30 business days out of service in total, within 1 year or the warranty term, whichever ends first. Meeting a test creates a presumption, which the manufacturer can still contest before the program or the court. Count each visit with its repair order, and keep every order with its dates.

Does the Oklahoma lemon law cover used or leased cars?

New motor vehicles up to 10,000 lb; not the living quarters of a motor home. Used cars: Not covered. A used car sold with the rest of the manufacturer’s warranty still carries that warranty, which federal law enforces even where the state lemon law stops. Leases are covered where the text names lessees.

Must I go through arbitration before suing under the Oklahoma lemon law?

A manufacturer dispute procedure that qualifies must be used first (§ 901(F)). Under the federal rule, 16 CFR Part 703, a manufacturer program that a warranty requires you to use first must decide within 40 days, and its decision does not bind you if you go to court afterwards. The warranty booklet names any program the manufacturer offers.
