The Arizona lemon law in detail

Arizona’s lemon law, sections 44-1261 to 44-1265 of the Arizona Revised Statutes, read on the legislature’s site on November 1, 2026, covers a new motor vehicle during the warranty term or two years or 24,000 miles from delivery, whichever comes first. A reasonable number of attempts is presumed after four repairs of the same nonconformity, or when the car has been out of service for a cumulative 30 calendar days. Before claiming a refund or replacement, the owner must give the manufacturer direct written notice and a chance to cure. If the manufacturer has an informal dispute procedure that complies with the federal rule, 16 CFR Part 703, the owner must use it first. The deadline is short: an action must be brought within six months after the earlier of the end of the warranty or two years or 24,000 miles.

Six months is the Arizona trap

Arizona gives one of the shortest windows in the country. Because the clock runs from the end of the protection period, a defect that becomes chronic in month twenty leaves only a few months to notify, go through any manufacturer program and file. Starting the written notice early costs nothing and keeps every option open.

Arizona also has a separate rule for used vehicles, section 44-1267, which works differently from the new car law and is not modeled by the checker on this page. For a new car, the refund is the purchase price with its collateral charges, less a reasonable allowance for the owner’s use, as the statute puts it.

Questions people ask

How many repair attempts make a car a lemon in Arizona?

The Arizona presumption starts at 4 attempts on the same defect, or 30 calendar days out of service in total, within 2 years or 24,000 miles or the warranty term, whichever ends first. Meeting a test creates a presumption, which the manufacturer can still contest before the program or the court. Count each visit with its repair order, and keep every order with its dates.

Does the Arizona lemon law cover used or leased cars?

New motor vehicles bought by a consumer in Arizona. Used cars: Separate used-vehicle rule in § 44-1267 (not covered by this tool). A used car sold with the rest of the manufacturer’s warranty still carries that warranty, which federal law enforces even where the state lemon law stops. Leases are covered where the text names lessees.

Must I go through arbitration before suing under the Arizona lemon law?

If the manufacturer runs an informal dispute procedure that complies with 16 CFR Part 703, you must use it before asking for a refund or replacement (§ 44-1265). Time limit: Lawsuit within 6 months after the earlier of the warranty end or 2 years / 24,000 miles from delivery (§ 44-1265).
