The Vermont lemon law in detail

Vermont’s lemon law, chapter 115 of title 9 of the Vermont Statutes, read on the legislature’s site on November 1, 2026, covers new vehicles sold, leased or registered in Vermont during the express warranty term. A reasonable number of attempts is presumed after three repairs of the same nonconformity, the first of them within the warranty term, or after a cumulative 30 calendar days out of service. The owner gives written notice to the manufacturer, and to the lessor for a lease, on forms the manufacturer provides, and chooses either the Vermont Motor Vehicle Arbitration Board or the manufacturer’s procedure. Proceedings must begin within one year after the express warranty ends. The text says dealers cannot be sued under the chapter; the claim is against the manufacturer.

The Vermont board

The Vermont Motor Vehicle Arbitration Board is a state board that hears lemon law cases, and the owner elects it in the notice. Choosing it on the manufacturer’s form is the formal start of the case.

Because the period follows the express warranty, a Vermont owner with a long warranty is covered for its whole length, but the first repair attempt must fall inside it. The one-year limit then runs from the end of that warranty, which the deadline calculator computes from the length you enter.

Winters matter in a Vermont claim. A car that will not start in the cold, or whose all-wheel drive fails on snow, is the kind of defect a board takes seriously, but only with repair orders written while the fault is present. Ask the dealer to note the temperature and the road conditions the first time.

Questions people ask

How many repair attempts make a car a lemon in Vermont?

The Vermont presumption starts at 3 attempts on the same defect, or 30 calendar days out of service in total, within the manufacturer’s express warranty term. Meeting a test creates a presumption, which the manufacturer can still contest before the program or the court. Count each visit with its repair order, and keep every order with its dates.

Does the Vermont lemon law cover used or leased cars?

New vehicles sold, leased or registered in Vermont; dealers cannot be sued. Used cars: Not covered. A used car sold with the rest of the manufacturer’s warranty still carries that warranty, which federal law enforces even where the state lemon law stops. Leases are covered where the text names lessees.

Must I go through arbitration before suing under the Vermont lemon law?

Vermont Motor Vehicle Arbitration Board, or the manufacturer’s procedure (§ 4173). Time limit: Proceedings within 1 year after the express warranty ends (§ 4179). Under the federal rule, 16 CFR Part 703, a manufacturer program that a warranty requires you to use first must decide within 40 days, and its decision does not bind you if you go to court afterwards. The warranty booklet names any program the manufacturer offers.
