The Texas lemon law in detail

Texas handles lemon law claims through the Texas Department of Motor Vehicles, under sections 2301.601 to 2301.613 of the Occupations Code. The department’s page and notice, read on November 1, 2026, set the tests: within 24 months or 24,000 miles, whichever comes first, a vehicle qualifies after four repair attempts on the same defect, after two attempts on a serious safety hazard, or after 30 days out of service, not counting days the owner had a comparable loaner. The owner must give the manufacturer written notice, certified mail preferred, and at least one chance to repair. The complaint goes to TxDMV with a $35 filing fee, within six months after the earliest of the warranty end, 24 months or 24,000 miles. Cars, trucks, vans, motorcycles, ATVs, motor homes and towable RVs, bought or leased, are covered.

A state agency decides in Texas

Texas does not leave lemon law claims to manufacturer programs. The department reviews the complaint and, when the case does not settle, holds a hearing that decides whether the manufacturer must repurchase, replace or repair. The $35 filing fee is the only cost the department sets.

Used vehicles in Texas get a warranty performance complaint instead: the department can order a repair under a remaining warranty but cannot order a buyback. The loaner rule matters too: days with a comparable car provided by the dealer do not count toward the 30.

Questions people ask

How many repair attempts make a car a lemon in Texas?

The Texas presumption starts at 4 attempts on the same defect, or 2 attempts for a serious safety defect, or 30 calendar days out of service in total, within 2 years or 24,000 miles or the warranty term, whichever ends first.

Does the Texas lemon law cover used or leased cars?

New cars, trucks, vans, motorcycles, ATVs, motor homes and towable RVs, bought or leased. Loaner days do not count. Used cars: Used vehicles: warranty-performance complaint only, no refund or replacement. A used car sold with the rest of the manufacturer’s warranty still carries that warranty, which federal law enforces even where the state lemon law stops. Leases are covered where the text names lessees.

Must I go through arbitration before suing under the Texas lemon law?

Complaint to the Texas Department of Motor Vehicles ($35 fee), which holds the hearing. Time limit: TxDMV complaint within 6 months after the earliest of the warranty end, 24 months or 24,000 miles. Under the federal rule, 16 CFR Part 703, a manufacturer program that a warranty requires you to use first must decide within 40 days, and its decision does not bind you if you go to court afterwards. The warranty booklet names any program the manufacturer offers.
